Corte suspende parcialmente el decretazo de AMLO que oculta informaci\u00f3n de sus megaobras."},"content":{"rendered":"\n<p>La Suprema Corte de Justicia de la Naci\u00f3n (SCJN) concedi\u00f3 al Instituto Nacional de Transparencia, Acceso a la Informaci\u00f3n y Protecci\u00f3n de Datos Personales (Inai) una suspensi\u00f3n provisional para que, de manera inmediata deje de surtir efecto el acuerdo del presidente Andr\u00e9s Manuel L\u00f3pez Obrador con el que fueron clasificados como de \u201cseguridad nacional\u201d los proyectos y obras prioritarias del gobierno federal.<br><br>La suspensi\u00f3n provisional contra la reserva de informaci\u00f3n de las obras de la actual administraci\u00f3n \u201csurtir\u00e1 efectos de inmediato y sin necesidad de otorgar garant\u00eda alguna, sin perjuicio de que pueda modificarse o revocarse derivado de alg\u00fan hecho superveniente\u201d, dice el acuerdo de la Corte.<br><br>\u201cEs procedente para que se suspendan todos los efectos y las consecuencias del acuerdo impugnado y que deriven en catalogar la informaci\u00f3n detallada en \u00e9ste como de inter\u00e9s p\u00fablico y\/o seguridad nacional, sin cumplir con los supuestos que las leyes respectivas prev\u00e9n para ese efecto\u201d, determin\u00f3 la SCJN.<br><br>Por otra parte, el M\u00e1ximo Tribunal neg\u00f3 la suspensi\u00f3n de \u201clas acciones que se indican en el acuerdo impugnado en relaci\u00f3n con los proyectos y obras del Gobierno de M\u00e9xico\u201d.<br><br>Cabe apuntar que el Inai envi\u00f3 el viernes pasado a la SCJN una controversia constitucional contra el \u201cdecretazo\u201d del presidente L\u00f3pez Obrador que inhabilitaba el acceso a la informaci\u00f3n sobre las obras de su gobierno.<br><br>El Inai se\u00f1al\u00f3 que el acuerdo mandatario \u201ctransgrede los principios de supremac\u00eda constitucional y legalidad, porque realiza una reserva anticipada y generalizada de la informaci\u00f3n relativa a esos proyectos u obras, vulnerando el derecho a saber de la sociedad\u201d.<br><br>El Instituto asegur\u00f3 que, al considerar esos proyectos como tema de seguridad nacional, una de las causales de reserva de informaci\u00f3n prevista en la Ley Federal de Transparencia, las dependencias y entidades de la Administraci\u00f3n P\u00fablica Federal pueden llegar a reservar, de manera general, la informaci\u00f3n relacionada con los proyectos y obras que el gobierno lleva a cabo.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" loading=\"lazy\"
